A business can easily confuse three different questions: when its audit report is due, when its income-tax return is due, and whether it is in the category covered by this extension. CBDT's official Income Tax India post answers the first two for the named category. This guide explains the scope and the records to finish without treating every September compliance deadline as extended.
What did CBDT extend on 28 September 2026?
| Filing for AY 2026–27 | Earlier date | Announced new date |
|---|---|---|
| Audit report for the covered category | 30 September 2026 | 21 October 2026 |
| Income-tax return for the covered category | 31 October 2026 | 21 November 2026 |
The return extension concerns persons at serial number 2 in the table below Explanation 2 to Section 139(1) of the Income-tax Act, 1961. CBDT says the 'specified date' for the audit report in the case of such persons is also extended. These are two separate filing steps; uploading the report does not submit the return. The official post identifies the category but does not assign a circular number, so no such number should be inferred from news summaries.
Who should check whether the extension applies?
Taxpayers whose return was due on 31 October 2026 because they fall in the stated audit-related category should check the announcement and the subsequent order against their own facts. A headline saying 'audit cases' is not enough to decide every company's, firm's, partner's, individual's or trust's date. People with a different return category, including transfer-pricing cases, should not import these dates without checking their separate rules.
The announcement does not itself change GST returns, company AGM dates, advance tax, or every certificate and report that might appear near the tax-audit deadline. Keep separate calendars for those obligations. It also does not say that related payment or interest consequences are waived; check the formal order and applicable law before reaching that conclusion.
Which audit form applies: 3CA–3CD, 3CB–3CD or new Form 26?
AY 2026–27 covers income earned in FY 2025–26. The Income Tax Department says this audit stays under Section 44AB of the 1961 Act. Use Form 3CA or Form 3CB, as appropriate, with Form 3CD. Its separate guidance places consolidated Form 26 in the Tax Year 2026–27 framework under the Income-tax Act, 2025, for a later filing cycle. The extension changes the announced date for the covered current audit, not the period or its form.
What should a business finish before 21 October?
Extra time is most useful when it closes specific open items. Assign each reconciliation an owner and an internal deadline before the statutory filing date. The steps below are planning suggestions, not additional legal filing requirements.
| Work item | Practical check | Keep as evidence |
|---|---|---|
| Confirm scope | Check Section 44AB applicability, FY/AY, taxpayer category and the new order | Written applicability and deadline note |
| Reconcile turnover | Compare books, GST returns, bank receipts and major sales records | Explanation of differences and final schedules |
| Close tax-audit disclosures | Resolve TDS, MSME ageing, expense and GST classification questions | Supporting records and reviewed Form 3CD data |
| Complete portal steps | Confirm CA assignment, report upload and taxpayer acceptance | Filed report and final acknowledgement |
| Prepare the return | Reconcile the final audited figures with the separate ITR | Filed and verified return acknowledgement |
The CA has uploaded the tax-audit report. Is the filing complete?
Check the taxpayer's pending actions on the e-filing portal. The Department's published workflow includes assigning the CA, the CA's submission, taxpayer acceptance and the prescribed verification step. Download the filed form and confirm its final status. Keep the audit report acknowledgement and the later ITR acknowledgement separately.
Does the new date also apply to Form 3CEB or transfer-pricing cases?
Do not assume it does. The Department's return guidance distinguishes the ordinary 31 October audit return route from the 30 November route for transfer-pricing cases. The 28 September post names the former category. Verify any later CBDT order and the applicable reporting rule before moving a transfer-pricing filing date.
Where should I look for the formal CBDT order?
Start with the official Income Tax India announcement linked in the sources below, then check the Income Tax Department's current circulars, notifications and e-filing updates for the implementing document. The press release expressly says it will be issued separately. A social post announcing a decision and an order giving it effect are different documents; this article will be updated if the order adds relevant details.
